A MAN who threatened to torch a shop assistant's home and watch her children burn to death after she challenged him over stealing a can of beer has been jailed.

Bob Marley, 51, was given a chance to stay out of prison after the offence, if he could get help and address his alcohol problem.

But just two weeks later he was caught on CCTV in Spring Bank West, west Hull, drinking from a can of lager in the street at 8am, in breach of his antisocial behaviour order (Asbo).

In the past six years, he has breached his Asbo 23 times.

Marley has previously been jailed for urinating in front of hundreds of war veterans during a Remembrance Sunday march.

He has pleaded guilty to theft and breaching his Asbo.

Hull Crown Court heard Marley threatened the woman when he tried to steal the can of alcohol from Lidl.

He told her: "I will get revenge and I will find out where you live. I will burn your house down and watch your kids burn to death."

Later, Marley was found outside the Tokyo nightclub in Anlaby Road, west Hull, at 1.20pm laid on the pavement.

An ambulance was called and he was treated for minor cuts to the side of his head but refused to go to hospital.

He asked medical staff to take him home but then became abusive to PCSOs who were there.

Marley told them: "I hate the police, you are all scum, send me to prison – you will be paying for me."

Marley also swore at people in the street.

Under the terms of an Asbo he was previously given, Marley is banned from causing harassment, alarm or distress to members of the public.

The case went to court and the judge gave Marley a chance to see if he could stay off alcohol.

Within two weeks, he breached it by drinking in public.

His barrister Jo Golding said: "He concedes custody is inevitable. He was given a chance by the judge and the chance has been breached and he has committed further offences.

"He was given two requirements to stay out of trouble and to abide by the directions of the drug and alcohol service.

"He left this court and went to the unit and received some assistance. He then went into hospital.

"He has epilepsy and suffered a stroke. The momentum that had started ceased.

"He is a vile nuisance when in drink and when drunk.

"He concedes this has to stop. The alcohol is the key and he is someone who knows it cannot continue.

"I ask you to impose a sentence that will give him some hope."

Now, the Honorary Recorder of Hull and the East Riding Judge Michael Mettyear has jailed Marley for six months.

The judge told him: "You are a hopeless case. You keep committing offences.

"You get given chances by the court and you are unable and unwilling to take them.

"You were given a chance and you didn't take advantage of that. Only custody can be justified."

Marley, of Hopwood Close, west Hull, pleaded guilty to two breaches of his Asbo.

He has breached the order more than 20 times and has 227 convictions, the court heard.

The Crown Prosecution Service asked the judge previously to extend his Asbo for another five years and has been told to apply to Hull Magistrates' Court.

It is due to expire in November.
